These Terms of Service govern your access to and use of the websites, hosting services, email services, customer portal, support services, and other products and services provided by Have Freedom Hosting.
1. Services Covered
These Terms of Service ("Terms") govern your access to and use of the websites, hosting services, email services, customer portal, support services, and other products and services provided by Have Freedom Hosting ("HFHosting," "we," "our," or "us").
By creating an account, purchasing a Service, or otherwise using Have Freedom Hosting, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.
These Terms apply to Have Freedom Hosting products and services including:
- Shared web hosting;
- WordPress hosting;
- Email hosting and webmail;
- cPanel hosting;
- FTP, SFTP, and SSH access;
- Software installation and management tools;
- Customer and billing portals;
- Technical support;
- Custom hosting packages; and
- Other hosting or infrastructure services we may offer.
Certain Services may include additional specifications, limitations, order terms, or written agreements. Where those terms conflict with these Terms, the more specific terms will control with respect to that Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to establish an Have Freedom Hosting account.
If you purchase or use Services on behalf of a business, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
3. Account Registration
You agree to:
- Provide accurate and current account information;
- Maintain accurate billing and contact information;
- Keep your account credentials secure;
- Use reasonable security measures to prevent unauthorized access; and
- Notify Have Freedom Hosting promptly if you suspect unauthorized access or compromise.
You are responsible for activity performed through your account unless the activity resulted directly from a security failure within systems controlled exclusively by Have Freedom Hosting.
You may not share account credentials in a manner that creates an unreasonable security risk or use another person's account without authorization.
4. Orders and Service Activation
Orders are subject to acceptance by Have Freedom Hosting. We may decline, delay, or cancel an order when reasonably necessary because of suspected fraud, inaccurate information, technical limitations, resource availability, security concerns, legal requirements, or an error in pricing or service configuration.
Automated provisioning may begin after payment is confirmed. Provisioning times shown on our website are estimates and are not guaranteed unless expressly stated otherwise in writing.
5. Billing and Payments
Have Freedom Hosting uses WHMCS for customer account management, invoicing, billing, and service administration. Payments are completed through PayPal.
You authorize Have Freedom Hosting and its payment providers to process charges associated with Services you order according to your selected billing cycle.
Depending upon the Service, billing may occur monthly, annually, or according to another billing period displayed when you place your order.
You are responsible for ensuring that your billing information remains accurate and that invoices are paid by their stated due dates.
PayPal processes payment credentials according to PayPal's own terms and privacy practices. Have Freedom Hosting does not directly receive your PayPal password or full payment account credentials.
6. Recurring Services and Renewals
Hosting and other recurring Services may renew automatically according to the billing cycle associated with your account unless you cancel the Service before renewal.
Renewal invoices may be generated before the applicable renewal date.
You may request cancellation through the Have Freedom Hosting customer portal or by contacting support.
Canceling or disabling a payment authorization with PayPal does not necessarily constitute cancellation of the underlying Have Freedom Hosting Service. You should submit a cancellation request directly to Have Freedom Hosting when you intend to discontinue a Service.
7. Late or Failed Payments
If an invoice is not paid when due, Have Freedom Hosting may suspend the affected Service.
Suspension may prevent access to services including websites, cPanel, FTP, SSH, email, and webmail.
Service may generally be restored after outstanding amounts are paid, provided that the account has not already been terminated or deleted.
Have Freedom Hosting does not guarantee that account data will remain available indefinitely after suspension, cancellation, or termination.
8. Refund Policy
Unless a specific promotion, written agreement, or applicable law states otherwise, payments made to Have Freedom Hosting are non-refundable.
Cancellation does not ordinarily result in a prorated refund for unused portions of a billing period.
This provision does not limit any refund or consumer right that cannot legally be waived.
If you believe you were charged incorrectly or more than once for the same transaction, please contact Have Freedom Hosting support so that the issue can be reviewed.
9. Prices and Service Changes
Have Freedom Hosting may change prices, package specifications, resource allocations, or available features.
When a price change affects an existing recurring Service, we will make reasonable efforts to provide notice before the new price applies to a future billing period.
We may modify technical features without advance notice where reasonably necessary for security, compatibility, maintenance, network operations, or legal compliance.
10. Customer Content
You retain ownership of files, databases, email, media, applications, and other content you upload, store, transmit, or create using Have Freedom Hosting Services ("Customer Content").
You grant Have Freedom Hosting a limited, non-exclusive right to store, copy, transmit, process, and otherwise handle Customer Content solely as reasonably necessary to:
- Provide the Services;
- Operate and maintain infrastructure;
- Provide requested technical support;
- Protect the security and reliability of the network;
- Investigate abuse or security incidents;
- Comply with applicable law or valid legal process; and
- Enforce these Terms.
This permission ends when the relevant Customer Content is removed from our systems, subject to temporary technical copies, logs, caches, or records that may remain as described in our Privacy Policy.
11. Your Responsibility for Customer Content
You are responsible for Customer Content and for the operation of websites, applications, mailing lists, databases, and other systems under your account.
You represent that you have the legal right to store, transmit, and use Customer Content.
You are responsible for ensuring that your use of the Services complies with applicable laws, contractual requirements, intellectual property rights, and privacy obligations.
12. Acceptable Use
Have Freedom Hosting generally permits customers to host lawful content and operate lawful services. You may not use Have Freedom Hosting Services in a manner that is illegal, abusive, malicious, fraudulent, or materially harmful to Have Freedom Hosting, our customers, our infrastructure, or other Internet users.
Prohibited activity includes, but is not limited to:
- Content or activity that violates applicable United States law;
- Fraud, scams, impersonation, or deceptive schemes;
- Phishing or credential theft;
- Distribution or operation of malware, ransomware, botnets, or malicious software;
- Unauthorized access to computers, networks, accounts, or data;
- Scanning or attacking third-party systems without authorization;
- Denial-of-service or distributed denial-of-service attacks;
- Using the Services as part of an attack against another network or system;
- Sending unsolicited bulk email or spam;
- Email address harvesting or use of unlawfully obtained mailing lists;
- Material infringement of copyrights, trademarks, or other intellectual property rights;
- Hosting or distributing material whose possession or distribution is unlawful;
- Interfering with the operation of Have Freedom Hosting systems or other customer accounts;
- Attempting to bypass account, security, bandwidth, or resource restrictions; and
- Activity that creates an unreasonable security, operational, or legal risk.
13. Resource Usage and Shared Hosting
Shared hosting resources are shared among multiple customers. You may not use a shared hosting account in a manner that materially degrades service for other customers or places unreasonable strain on shared infrastructure.
Excessive usage may include sustained or abnormal consumption of:
- CPU resources;
- Memory;
- Disk input and output;
- Disk space;
- Network capacity;
- Database resources;
- Concurrent processes;
- Email queues; or
- Other shared system resources.
Where practical, we may contact you to discuss the issue and possible solutions. We may also temporarily limit, throttle, isolate, or suspend resource-intensive activity where reasonably necessary to protect system stability.
Have Freedom Hosting may recommend or require migration to a more appropriate package where a workload is not reasonably suitable for shared infrastructure.
14. Unmetered or High-Capacity Features
Terms such as "unmetered," "high capacity," or similar descriptions do not mean that use is without technical or operational limits.
All Services remain subject to the applicable package specifications, reasonable use, available infrastructure capacity, and the resource provisions of these Terms.
15. Email and Anti-Spam Requirements
Have Freedom Hosting email services may be used for legitimate personal, organizational, or business communications, including legitimate permission-based mailing lists.
You may not use Have Freedom Hosting Services to send unsolicited bulk email or spam.
Customers operating mailing lists or newsletters are responsible for complying with applicable anti-spam laws, honoring unsubscribe requests, maintaining appropriate mailing-list practices, and ensuring that recipients have been contacted lawfully.
Have Freedom Hosting may temporarily restrict outbound email when necessary to protect our network reputation, investigate spam complaints, contain compromised accounts, or prevent abuse.
16. Email Delivery
Have Freedom Hosting does not guarantee that every email message will be accepted, delivered, or placed in a recipient's inbox.
Email delivery can be affected by recipient servers, third-party filtering, blocklists, DNS configuration, sender reputation, spam filters, Internet routing, and circumstances outside Have Freedom Hosting's control.
17. Security Responsibilities
Have Freedom Hosting implements security measures intended to protect its infrastructure, but customers remain responsible for securing systems and applications under their control.
This includes maintaining:
- Strong and unique passwords;
- Secure SSH keys;
- Current software versions;
- Updated content management systems;
- Updated themes and plugins;
- Appropriate file permissions;
- Secure application configuration; and
- Appropriate access controls.
Features such as automatic updates, managed WordPress updates, SSL certificates, spam filtering, or DDoS mitigation reduce certain risks but do not eliminate the customer's responsibility to maintain secure applications and credentials.
18. DDoS Protection and Network Protection
Have Freedom Hosting may provide DDoS mitigation and other network-security measures.
These protections are designed to reduce risk but do not guarantee that every attack will be prevented or that Services will remain accessible during every attack.
To protect our infrastructure or other customers, Have Freedom Hosting may temporarily filter traffic, rate-limit connections, block traffic, isolate a Service, change routing, or take other reasonable mitigation measures.
19. Backups and Data Loss
You are responsible for maintaining backups of:
- Website files;
- Databases;
- Email;
- Configuration files;
- Application data;
- Media; and
- Other information stored through the Services.
You should not use Have Freedom Hosting as the sole location of any information that cannot reasonably be replaced.
Temporary snapshots, caches, migration copies, filesystem copies, or other technical data that may occasionally exist do not constitute a backup service and may be deleted at any time.
Have Freedom Hosting does not guarantee recovery of lost, deleted, damaged, compromised, or otherwise unavailable Customer Content.
20. Cancellation and Data Removal
You may cancel a Service through the customer portal or by contacting Have Freedom Hosting support.
You are responsible for downloading or transferring any Customer Content you wish to retain before cancellation becomes effective.
Following cancellation or termination, Have Freedom Hosting may delete Customer Content and account data associated with the terminated Service.
We do not guarantee any retention period or ability to restore Customer Content after a Service has been terminated.
21. Suspension
Have Freedom Hosting may suspend all or part of a Service when reasonably necessary because of:
- Nonpayment;
- A violation of these Terms;
- Suspected account compromise;
- Malware or malicious activity;
- Spam or network abuse;
- Excessive resource consumption;
- A threat to Have Freedom Hosting infrastructure or other customers;
- A valid legal requirement;
- A credible abuse complaint requiring investigation; or
- Another material security or operational risk.
Where reasonably possible and appropriate, we will attempt to notify the customer and provide an opportunity to resolve the issue.
Immediate action may be taken without advance notice where delay would create a material security risk, legal risk, service disruption, or risk of harm to others.
22. Termination
Have Freedom Hosting may terminate a Service or account for material violations of these Terms, repeated abuse, nonpayment, fraud, unlawful activity, substantial security risk, or other circumstances in which continued service would create an unreasonable legal or operational risk.
We may also discontinue a product or terminate a Service for legitimate business or operational reasons. Where reasonably practical, we will provide advance notice in such circumstances.
You may discontinue use of the Services at any time, subject to outstanding payment obligations and applicable cancellation procedures.
23. Regulated and Sensitive Data
Have Freedom Hosting does not represent that its standard hosting Services satisfy any particular industry-specific compliance framework unless Have Freedom Hosting expressly agrees to that requirement in writing.
You should not use standard Have Freedom Hosting Services to store or process information requiring specialized contractual or regulatory safeguards unless you have first confirmed with Have Freedom Hosting that the intended use is supported.
This may include information subject to specialized healthcare, financial, payment-card, governmental, or other regulated-data requirements.
24. Copyright and Intellectual Property Complaints
Have Freedom Hosting respects intellectual property rights and may investigate credible complaints regarding content hosted through our Services.
Copyright complaints may be submitted to support@hfhosting.us.
A copyright complaint should include:
- The complainant's name and contact information;
- Identification of the copyrighted work claimed to have been infringed;
- Identification and location of the allegedly infringing material;
- A statement that the complainant has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement that the information provided is accurate and, where applicable, that the complainant is authorized to act for the rights holder; and
- A physical or electronic signature.
Have Freedom Hosting may remove or disable access to material when legally required or when reasonably appropriate after reviewing a credible infringement complaint.
We may notify the affected customer and may accept an appropriate response or counter-notification where applicable.
Have Freedom Hosting may terminate accounts of repeat infringers where appropriate.
25. Abuse Reports
Abuse, malware, phishing, spam, security, or other complaints concerning an Have Freedom Hosting account may be sent to support@hfhosting.us.
Reports should include sufficient information to identify the affected domain, IP address, URL, email, account, or activity and should include supporting information where reasonably available.
Submitting an abuse complaint does not guarantee a particular outcome. Have Freedom Hosting will evaluate reports based on available information, applicable law, these Terms, security considerations, and the circumstances of the complaint.
26. Third-Party Software and Services
Have Freedom Hosting Services may provide access to or rely upon third-party software, platforms, applications, or services, including WHMCS, PayPal, cPanel, Softaculous, WordPress, Roundcube, and other software.
Third-party products may be subject to their own licenses, terms, privacy policies, availability, and technical limitations.
Have Freedom Hosting is not responsible for changes, failures, discontinuation, or defects in third-party products outside our reasonable control.
27. IP Addresses and Technical Configuration
IP addresses, server assignments, nameservers, routing arrangements, software versions, and other technical resources may be changed when reasonably necessary for maintenance, migration, security, network management, provider changes, or other operational reasons.
Unless expressly stated otherwise in a written agreement, assignment of an IP address does not transfer ownership of that address to the customer.
28. Maintenance and Service Changes
Have Freedom Hosting may perform scheduled or emergency maintenance when reasonably necessary to maintain, secure, repair, update, or improve the Services.
We will make reasonable efforts to minimize disruption and to provide advance notice of planned maintenance where practical.
Emergency maintenance may occur without advance notice.
29. Uptime and Service Availability
Have Freedom Hosting works to provide reliable hosting infrastructure, but Internet and hosting services cannot be guaranteed to operate without interruption.
Any published uptime percentage is informational or a service objective unless a separate written Service Level Agreement expressly identifies it as a contractual guarantee.
Published uptime figures do not, by themselves, create an entitlement to a refund, credit, or other compensation.
Service may be affected by maintenance, software failures, hardware failures, network routing, upstream providers, security incidents, DDoS attacks, Internet conditions, or events outside Have Freedom Hosting's reasonable control.
30. Support
Have Freedom Hosting provides customer support through the channels made available on our website and customer portal.
References to 24/7 support mean that support requests may be submitted at any time. They do not guarantee an immediate response or resolution within a particular period unless a separate written agreement specifies a response time.
Resolution times may vary depending upon the complexity of the issue, third-party dependencies, customer cooperation, and other circumstances.
31. Customer Support Access
When you request technical support, you authorize Have Freedom Hosting personnel to access relevant portions of your hosting account when reasonably necessary to diagnose or resolve the issue.
This may include access to:
- Configuration files;
- Logs;
- Databases;
- Website files;
- Email settings;
- Applications; and
- Other relevant technical information.
Such access will be limited to legitimate support, security, abuse, or operational purposes.
32. Privacy
Have Freedom Hosting's collection and handling of personal information is described in our Privacy Policy.
Customers that collect personal information through websites or applications hosted by Have Freedom Hosting are responsible for their own privacy notices, legal bases, consent mechanisms, and other privacy obligations.
33. Have Freedom Hosting Intellectual Property
Have Freedom Hosting names, logos, website designs, documentation, original written materials, and other Have Freedom Hosting-owned content remain the property of Have Freedom Hosting or the applicable rights holder.
These Terms do not transfer ownership of Have Freedom Hosting intellectual property to you.
34. Feedback
If you voluntarily provide suggestions or feedback concerning Have Freedom Hosting products or Services, you permit Have Freedom Hosting to use that feedback without an obligation to compensate you.
This provision does not transfer ownership of unrelated Customer Content or other intellectual property you own.
35. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available."
Have Freedom Hosting does not warrant that the Services will be uninterrupted, completely error-free, completely secure, compatible with every application, or suitable for every intended purpose.
Have Freedom Hosting disclaims implied warranties to the extent such warranties may lawfully be disclaimed.
Nothing in these Terms excludes any warranty or consumer protection that cannot legally be excluded.
36. Limitation of Liability
To the fullest extent permitted by applicable law, Have Freedom Hosting will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, business, goodwill, opportunities, or data, arising from or related to the Services.
To the fullest extent permitted by applicable law, Have Freedom Hosting's aggregate liability for claims arising from or relating to an affected Service will not exceed the amount paid by you to Have Freedom Hosting for that Service during the twelve months immediately preceding the event giving rise to the claim.
If you have used the affected Service for less than twelve months, the limitation will not exceed the amount actually paid for that Service during the period you used it.
These limitations do not apply where applicable law prohibits such a limitation.
37. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Have Freedom Hosting harmless from third-party claims, damages, liabilities, and reasonable costs arising from:
- Your Customer Content;
- Your unlawful use of the Services;
- Your material violation of these Terms;
- Your infringement of another person's rights; or
- Activity conducted by users you authorize to access your account.
This provision does not require you to indemnify Have Freedom Hosting for claims caused by Have Freedom Hosting's own unlawful conduct where such an obligation would be prohibited by law.
38. Events Outside Our Control
Have Freedom Hosting will not be responsible for failure or delay caused by circumstances outside our reasonable control, including:
- Natural disasters;
- Severe weather;
- Utility failures;
- Internet routing failures;
- Upstream provider outages;
- Large-scale cyberattacks;
- DDoS attacks;
- Governmental actions;
- Labor disruptions;
- War or civil disturbance; or
- Similar events beyond our reasonable control.
39. Governing Law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law principles.
Nothing in this section eliminates rights granted by applicable law that cannot legally be waived by contract.
40. Changes to These Terms
Have Freedom Hosting may update these Terms to reflect changes in our Services, technology, business practices, security requirements, or applicable law.
The "Last Updated" date at the beginning of these Terms will be changed when the Terms are revised.
For material changes affecting existing customers, we may provide additional notice through the Have Freedom Hosting website, customer portal, email, or another reasonable method.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
41. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
42. No Waiver
Have Freedom Hosting's failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision in the future.
43. Assignment
You may not transfer your contractual rights or obligations under these Terms to another party without Have Freedom Hosting's consent.
Have Freedom Hosting may transfer these Terms as part of a merger, acquisition, reorganization, sale of assets, or similar business transaction, subject to applicable law.
44. Entire Agreement
These Terms, the Privacy Policy, applicable order details, and any separate written agreement governing a particular Service constitute the agreement between you and Have Freedom Hosting concerning the Services.
